El movimiento busca evitar un recurso ante el Tribunal Constitucional y dejar margen a una soluci\u00f3n pactada sobre aspectos clave de la pol\u00edtica de vivienda en la comunidad.<\/p>\n<h2>La vivienda andaluza, bajo revisi\u00f3n del Gobierno<\/h2>\n<p>El acuerdo fue adoptado el 23 de marzo de 2026 en el marco de la Comisi\u00f3n Bilateral de Cooperaci\u00f3n entre la Administraci\u00f3n General del Estado y la comunidad aut\u00f3noma, y qued\u00f3 publicado el 13 de abril tanto en el <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2026-8197\" target=\"_blank\" rel=\"noopener\">BOE<\/a> como en el <a href=\"https:\/\/www.juntadeandalucia.es\/boja\/2026\/69\/32\" target=\"_blank\" rel=\"noopener\">BOJA<\/a>. Adem\u00e1s de iniciar las negociaciones, ambas administraciones han acordado crear un grupo de trabajo para proponer una salida t\u00e9cnica al conflicto.<\/p>\n<p>Las diferencias se concentran en varios puntos sensibles de la norma: la definici\u00f3n de vivienda y sus tipolog\u00edas, las f\u00f3rmulas de colaboraci\u00f3n p\u00fablico-privada para impulsar vivienda protegida y alquiler asequible, los usos compatibles del suelo dotacional p\u00fablico, el Libro del Edificio y Manual del Usuario de la Vivienda, as\u00ed como las obras de redistribuci\u00f3n y mejora en edificios residenciales.<\/p>\n<h2>Qu\u00e9 art\u00edculos de vivienda centran el conflicto<\/h2>\n<p>Los preceptos cuestionados por el Ejecutivo central son los art\u00edculos 4, 13, 14, 24, 31, 40, 49, 50, 51, 52, 63, 64, 66, 89, 90 y 96, adem\u00e1s de la disposici\u00f3n final tercera. Entre los asuntos incluidos figuran la regulaci\u00f3n del Registro de Agentes Inmobiliarios Especializados del Sector Residencial de Andaluc\u00eda, la promoci\u00f3n y calificaci\u00f3n de viviendas protegidas, y las f\u00f3rmulas de concesi\u00f3n, derecho de superficie, usufructo o cesi\u00f3n de uso sobre inmuebles o suelos p\u00fablicos.<\/p>\n<p>Tambi\u00e9n est\u00e1 bajo revisi\u00f3n la modificaci\u00f3n del Reglamento andaluz de Viviendas Protegidas en cuestiones como el procedimiento de selecci\u00f3n de adjudicatarios y la calificaci\u00f3n provisional de las promociones. El alcance de estas diferencias vuelve a situar el debate competencial en el centro de la agenda institucional andaluza.<\/p>\n<h2>La negociaci\u00f3n abre margen antes del Constitucional<\/h2>\n<p>La comunicaci\u00f3n remitida al Tribunal Constitucional se apoya en el art\u00edculo 33.2 de la Ley Org\u00e1nica del TC, que permite activar negociaciones entre administraciones para intentar evitar la presentaci\u00f3n de un recurso de inconstitucionalidad. En la pr\u00e1ctica, el paso dado por ambas partes abre una fase de di\u00e1logo jur\u00eddico y pol\u00edtico antes de una posible impugnaci\u00f3n formal.<\/p>\n<p>M\u00e1s all\u00e1 del choque competencial, el episodio refuerza el foco sobre la vivienda protegida, la necesidad de ampliar el alquiler asequible y las dificultades de acceso de los <a href=\"https:\/\/www.habitatinsulae.es\/ca\/vivienda-joven\/\" target=\"_blank\" rel=\"noopener\">j\u00f3venes<\/a> al mercado residencial.
